These are the Terms of Business by which rightperson-online.com operates and are deemed to be a legally binding document.  Please read them carefully, as you will be asked to state that you have understood and agree to abide by them and in doing so are entering into a legal agreement with rightperson-online.com.

These Terms and Conditions apply to all persons who access the website rightperson-online.com, whether registered as a User or a Visitor.  They are deemed to be accepted on completion and submission of the Registration form or in accessing, browsing, viewing or using any services provided by rightperson-online.com which does not require specific registration. Such usage as well as completion of registration forms a contract of agreement between the User and rightperson-online.com.

These Terms and Conditions shall be incorporated into and govern the contract of agreement between all those who access the website of rightperson-online.com, whether registered or visitors the User and rightperson-online.com at all times.

The purpose of rightperson-online.com is to allow Hosts and Applicants to be able to contact each other.  We are not an au pair, nanny or recruitment or employment agency and are not involved with any individual selection processes or contracts of ‘matched’ Members.  Nor do we or can we vouch for the suitability or otherwise of any individual hosts, applicants or agencies.

Our fee is a membership fee to gain access to a large database of potentially suitable hosts/applicants so that Users may have control over their own recruitment and selection processes.  To find your own Host/Applicant by using this site is an inexpensive way of searching for, finding and accepting/engaging your own host or applicant.  It remains the User’s responsibility to satisfy themselves that all legal requirements are being met in so-doing and that sufficient relevant documentation checks have been made.

Specialist agencies may also become Members of this site and may from time to time approach Users to offer their services.  

To make available to Members, the contact details of Applicants interested in finding a suitable Host and of Hosts interested in finding a suitable Applicant.  

Rightperson-online.com will keep the personal contact details of Hosts and Applicants secure and will only display what it believes in good faith, to be bona fide Host and Applicant members.

Rightperson-online.com reserves the right to decline, without explanation, an application for Membership.  In any such cases, no Membership charge would be requested.  

Rightperson-online.com reserves the right to gather statistics from data submitted to the website by Users in order to further streamline and improve the business and to potentially publish this information as deemed fit.     

By agreeing to these Terms & Conditions, Hosts and Applicants (Users) warrant and confirm…

That you meet the definition of Host or Applicant and have completed the appropriate Membership form.

That you are who you say you are and that the information you give is honest and accurate.

That you are aged 18 or above. 

That you are responsible for the entire content of information logged against your user profile.

That you have completed the relevant forms yourself and that it has not been completed by someone other than you with the purpose to deceive or defraud.  If language help has been given, this should be stated on the form.

That you will immediately make any changes to the information on your profile, as necessary.

That you will not create more than one active profile.

That you will keep all passwords confidential and will not allow shared access with any third party.

That you warrant payment of the Membership fee for the current published term.  Membership will be granted and will commence as soon as payment has been validated by the payment process. Payment may be made by most major, internationally accepted credit or debit cards.

That you will only input any contact details in the allotted sections of the Registration form. No contact information, including postal address, email addresses, Skype or Internet phone addresses, chat address, contact numbers or address of a web page which holds any of the aforementioned details should be placed in any section of the membership form not specifically dedicated for this purpose. Rightperson-online.com reserves the right to remove, block or delete any such information it finds where this obligation is flouted and which may result in the termination of the Membership of this User with no refund.

That you agree that by submitting your details, any image or information which is part of your profile may be reproduced and displayed on our Internet platform.  You are granting rightperson-online.com a royalty-free, non-exclusive license to use and copy all or part of your information or images on the rightperson-online.com website. By so-doing you should be clear that your data will be available and accessible to fellow Members of rightperson-online.com, including member Agencies.

That you will not upload, email or in any way publish, display or distribute illegal, sexual, defamatory, threatening or insulting material which may cause offence or contravene the laws of taste and decency – either in written or pictorial form.  If such information is discovered to have been published on our website, you agree that rightperson-online.com has the right to delete or edit this information at any time and without warning.

That you will not enter information or create multiple profiles with the intention or perceived intention to defraud, ‘hustle’, ‘scam’, deceive or extort the end user in any way, shape or form.

That you will not in any way distribute or attempt to distribute (including uploading, emailing, inserting, ‘hacking’, sending) information that contains any type of virus or other damaging files, programs or codes with the intention to cause damage to software functionality.

That you will not use the Internet platform of rightperson-online.com in any way to promote services or display messages which might be seen in any way to be taking business directly away from rightperson-online.com or to be ‘advertising’ competition.

That you will not use Membership with rightperson-online.com to obtain information or collect data about other Members with intention to re-use them for trade purposes.

That you understand that from time to time Member Agencies may approach Hosts or Applicants with the express purpose of helping them with their search.  It is understood that their services are separate from those of rightperson-online.com and that although they may offer Hosts/Applicants a reduced fee for their services (as Members of rightperson-online.com), they nevertheless charge additional fees.

It is free of charge to register to use the site of rightperson-online.com.  In doing so, Hosts and Applicants will become Users and be required to agree to these terms and conditions.

Once registered, a User is offered the choice to become a full Member.  In doing so, they will be charged a Membership fee. 

To see the Membership fees, the Host or Applicant must first become a User.

Current Membership fees will be displayed on the web site prior to committing to payment.  Rightperson-online.com reserves the right to alter fees at its own discretion and with no prior warning from time to time.  It is therefore the responsibility of the User to check the current fees.

From time to time rightperson-online.com may offer promotions which may alter or affect the fee structure.  It is the responsibility of the User to observe these offers and realise that they may be for a limited period only and may not be repeated.

Rightperson-online.com may offer different classes of Membership costed at different fees. For instance Users will have a choice whether to become a Member at a set lower fee, or a Priority Member at a slightly higher fee for greater exposure on the web site.

Membership fees are not refundable.  Once a User has paid to become a Member, they are provided with full access to the Host and Applicant database which will provide full contact information on these Users.  If a User decides not to access this information, this is at their own discretion and rightperson-online.com is not obliged to and will not refund any membership fee. Memberships may not be ‘frozen’ or put ‘on hold. In the case that a Member does not fully utilize their membership during the allotted time period, it is forfeited and the User will have to re-new their membership.

Rightperson-online.com expressly excludes all liability for any damage, loss, theft, expense or inconvenience, whether direct, indirect, and consequential or by omission, resulting in the engagement of an Applicant or acceptance of an engagement by an Applicant where contact has been made via rightperson-online.com. We will not be held responsible in any circumstances, including but not limited to, negligence, damages, loss of profits, data, lost wages or any harms or damages, direct or indirect, incidental, punitive, special, exemplary or consequential, caused by using the rightperson-online.com site and its services. Rightperson-online.com offers no warranties for finding a Host or Applicant and cannot be held responsible for the suitability or otherwise of any person registered as a User on the site and accepts no liability for the content of the information they have submitted.  All products and services of rightperson-online.com are provided ‘as is’ with no warrantees. Any communication with other Members is at the sole discretion of the User and rightperson-online.com shall not be responsible for any expense or risk entered into by the User, which is of their own accord. The quantity, quality, accuracy and validity of all material are the sole responsibility of the User and using the web site is at your own risk. Any loss of information caused by the User whilst uploading or downloading will be the User’s responsibility. Rightperson-online.com does not warrantee that your details will not be used by a third party and would advise Users to be aware of our scam notices. Rightperson-online.com reserves the right to delete, edit, amend, block or in any other way remove any communication to the site which is an abuse of our Terms & Conditions. If Users in this instance are Members, then no refund will be made and no discussion entered into. Whilst we will endeavour to maintain the site so that any information contravening our Terms or causing offence in any way is immediately removed, we do not claim rights of ownership and make no guarantee of content control. The User exempts rightperson-online.com from all requirements regarding copyrights, trademarks, patents and other intellectual property rights in any content or material contained in their profile.  This may include but is not limited to, images, graphics, logos, artwork, photographs, text or any other similar material). In the case of any protected trademark or copyrighted text being used within a User’s profile, rightperson-online.com is granted permission to publish, copy and distribute it. If a User is using texts or any kind of protected or trademarked information or images within their Profile for which they have not prior authorization to use or to grant third party authorisation for rightperson-online.com, then the User will be liable for all costs pertaining to any claim. Rightperson-online.com makes no warranties, express or implied, without limitation, as to the reliability of this website. We cannot guarantee that the site will be free of errors, viruses, malicious codes, spam or any other unwanted interference and make no warranties as to the site’s performance or security. Users access the site and communicate with other Members at their own risk. Should these communications result in any damage, material or otherwise, rightperson-online.com shall not be held in any way responsible.  Rightperson-online.com makes no warrantee that disruptions to the service caused by situations outside the control of rightperson-online.com will not occur. 
 
IMDEMNITY

You Agree to protect us from, indemnify us and fully compensate rightperson-online.com and its services providers for any and all third party claims, damages, liability, charges, expenses and costs (including but not limited to, reasonable court or legal costs), that may arise from your use and/or breach of the Terms & Conditions, or any claim we may make against you, or your infringement, or infringement by any other user of your account.

Agreeing to these Terms & Conditions also includes acceptance of the rightperson-online.com data protection policies.

Rightperson-online.com will publish User information on its web site and will actively encourage other Members to make contact with you. You are free to hide, edit or remove your details at any time.

Rightperson-online.com will not provide your details to any third party for marketing purposes. However, rightperson-online.com does not warrantee that your details will not be available to any third party who is a Member and uses them for marketing purposes.

rightperson-online.com will use your details to communicate with you may contact you from time to time with a view to helping us improve our services or to tell you about any improvements or promotions.

If at any time, you would like your profile and all details pertaining to you removed from our database, please contact us at xxxxxxx ,

Rightperson-online.com grants a limited, revocable, and non exclusive right to create a hyperlink to any page on rightperson-online.com websites, so long as the link does not portray rightperson-online.com or its products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any rightperson-online.com graphic, logo trademark or image as part of the link without express written permission. This site contains links to third party web sites that are maintained by others. These links are provided solely as a convenience to you and not as an endorsement by rightperson-online.com of the contents on such third-party Web sites. Rightperons-online.com is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third-party Web sites.

Rightperson-online.com reserves the right to make any additions or changes to the above Terms & Conditions and is not obliged to inform its Members of such changes.  It is the responsibility of the User to regularly check this document and note any alterations.

These Terms & Conditions are subject to the laws of England.  You agree to submit to and be bound by the Law of England in agreeing to these Terms and in Submitting your agreement.  The Contract is and shall be deemed to have been made in England and shall in all respects be governed by English Law and shall be subject to the jurisdiction of the English Courts.

In the event that any part of these Terms and Conditions be found to be or become invalid, illegal or unenforceable in any respect under any law, the enforceability and validity of the remaining terms shall not in any way be affected or impaired thereby.

If there is any discrepancy between these Terms and any translation of these Terms, this, the English version, shall apply.
